• 1 The Promoter
    This Competition is being promoted by Shaftesbury Soho Limited whose registered office is at 22 Ganton Street, Carnaby, London W1F 7BY  (“the Promoter”)
  • 2 Eligibility
    2.1 The competition is open to all United Kingdom residents aged 18 or over, except those who are employees of the Promoter, any of its wholly owned subsidiaries or any marketing services agency or other company involved directly with the administration of this competition, or any member of their households.
    2.2 All entrants must be “unsigned” and must own the copyright in the recording submitted for entry:  this means that entrants must not be subject to any ongoing recording or publishing agreement or any other agreement or arrangement which might in any way affect or inhibit the Promoter’s free and unfettered right to utilise the entrant’s services or the products thereof for the purpose of this Competition.
    2.3 All entrants warrant that all performers appearing on their entry have given their consent for to the making of the recording and for its submission to the competition.
    2.4 All songs must be written by the entrant and be original and unpublished.  So-called “cover-versions” will not be eligible for entry.
    2.5 All entrants warrant that the entry and all information submitted by them will not infringe the intellectual property, performance rights, privacy or any other rights of any third party and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.
    2.6 The winning entrant must be free to record the winning song at a time and studio reasonably selected by the Promoter and agrees to perform such reasonable promotional duties as required by the Promoter as part of the “Berwick Street Calling” series of events.  The Promoter currently anticipates the recording session taking place over a two-day period during the week commencing 5th July 2016.  
    2.7 Any failure to meet the eligibility requirements may result in disqualification and the forfeiture of the Prize.
  • 3 Entry
    3.1 All information detailing how to enter the Competition forms part of these Terms and Conditions.  It is a condition of entry that all rules are accepted as final and that the entrant agrees to abide by these Rules.  The decision of the judges is final and no correspondence will be entered into.  Submission of an entry will be taken to mean acceptance of these Rules.
    3.2 Entry must be made by submission via a YouTube link, Soundcloud or CD drop into the Soho Radio music box at 22 Great Windmill Street, London W1D 7LD or via email to submissions@berwickstreetlondon.co.uk together with a photograph of all performers].  All entries must be accompanied with full details of all performers appearing upon the entry and all composers of the composition together with their names, addresses and email addresses.
    3.3 All entries must be received to the above address by no later than 30th May 2016.
    3.4 There is no entry fee and no purchase necessary to enter this Competition.
  • 4 Copyright
    The copyright in all entries submitted to the Competition will remain with the respective entrants.  All entrants grant to the Promoter a worldwide, irrevocable, perpetual license to utilise their entry in any and all media for the purpose of publicising the Competition and “Berwick Street Calling”.
  • 5 Validity
    There is a limit of one entry per entrant.  Responsibility cannot be accepted for entries lost, damaged, delayed or corrupted in transit.  Proof of transmission will not be accepted as proof of receipt.  Correspondence will be entered into only at the absolute discretion of the Promoter.
  • 6 To win
    A panel of expert judges will review the entries and compile a shortlist of what they consider to be the 10 best entries. The judges’ decision will be final. The Promoter will then publish the shortlist on the [Berwick Street Calling] website for the purpose of a public vote.  The winning entry will be that which receives the greatest number of public votes. 
  • 7 The prize
    7.1 The prize will be for the winning entrant to record their song during no more than two days in a professional recording studio with a professional record producer. The winning entrant warrants that they will comply fully with the reasonable requirements and directions of the producer of the winning recording (including the terms of the producer’s agreement) and the employees and servants of the Promoter.  The winning entrant will be have the recording of their song pressed onto vinyl;  1,000 copies of the recording will be pressed with 250 copies being given to the winning entrant and 750 copies being given away by the Promoter at the Promoter’s entire discretion to shops, restaurants and businesses within the Berwick Street area for free distribution to members of the public.  The copyright in the recording of the winning entry will belong to the winning entrant.
    7.2 The prizes as described are correct as at the date of publication.  All prizes are non-transferable and there are no cash alternatives.
    7.3 Events may occur which render the competition itself or the awarding of the prize impossible due to reasons beyond the control of the Promoter and the Promoter may at its absolute discretion very or amend the promotion and the entrant agrees that no liability shall attach to the Promoter as a result thereof.
  • 8 Winner announcement
    The name of the winner will be published on the Berwick Street Calling website during the week commencing week commencing 5th July 2016 and the winner will be notified personally by email or post as soon as practicable either before or after this date.
  • 9 Winner publicity
    Entrants accept that, if they win, the Promoter will have the right, without additional payment or permission, to use the winning entry together with the entrants’ name, age, town of residence and likeness for the purposes of announcing the winner of this competition and for related promotional purposes.
  • 10 Governing Law
    The Competition and these terms and conditions will be exclusively governed by English law and any disputes will be subject to the exclusive jurisdiction of the English Courts.
  • Voting Terms And Conditions
  • Only one entry per e-mail address.  
    Voting closes on 23 June at 23:59.
    The artist with the most votes will win.
    Winner announced 5 July 2016 on BerwickStreetLondon.co.uk.
